Prosecutor tells court: 'You could have driven bus through gap'
An uninsured Kirk Michael man who crashed into a takeaway’s parked delivery vehicle has been fined almost £2,000.
James Myles Ormerod, of Barregarrow, had denied driving without due care and attention - and failing to report the incident - but changed his pleas at Douglas Courthouse.
The prosecutor told the court the 25-year-old had hit the car on 18 April, on Christian Street in Peel, whilst he was driving his BMW; he caused ‘substantial damage’ costing more than £1,500.
"You could have driven a bus through the gap," the prosecutor told the court.
Ormerod’s advocate said his client had taken ‘avoiding action’ after someone walked out in front of him adding: "He panicked and that’s why he parked up and didn’t report to police."
However he conceded: "Whatever the pedestrian was doing Mr Ormerod could, and should, have avoided the parked vehicle."
Fining Ormerod £1,900 and ordering him to pay compensation, as well as prosecution costs of £200, Deputy High Bailiff Rachael Braidwood also endorsed his licence with 11 penalty points.
"This was a serious incident. Please make sure you drive carefully in future," she told him.
A charge of failing to stop after the incident was withdrawn by the prosecution.
