Phoenix Law claims Walter Wannenburgh applied the wrong legal test when turning down request for a new inquest
The law firm representing a campaign group says it will challenge the Attorney General’s decision not to grant a new inquest into the Summerland fire.
Phoenix Law, which represents Justice for Summerland, has written to Walter Wannenburgh questioning his ruling.
Phoenix Law describes the 28-page letter as pre-action protocol ahead of lodging a Petition of Doleance challenging the decision.
It argues the Attorney General’s decision in May applied the wrong legal test, failed to give proper consideration to the advancement of forensic science and contravenes the European Convention of Human Rights.
Phoenix Law also says Mr Wannenburgh misinterpreted the meaning of misadventure - the verdict the campaign group is seeking to overturn.
The legal team says it will issue judicial review proceedings in the high court if it does not receive a response by 5pm next Monday.
The Isle of Man Government has confirmed the letter has been received and is being considered.
