Interim relief claim rejected by tribunal

A new panel will be appointed to hear the full case

A former company secretary who claims she was forced out of her job after making protected disclosures has lost her bid for interim relief at an employment tribunal.

Jane Passey resigned from Tufton Management Limited on 1 September 2026 and began proceedings on 6 September, alleging constructive unfair dismissal and automatic unfair dismissal over protected disclosures.

In a decision dated 6 October, the tribunal dismissed her application for interim relief, which could have required the company to keep paying her salary until the case concluded.

The tribunal said such relief has been described as 'draconian' and that a respondent required to pay ongoing salary could be left permanently out of pocket. It said close scrutiny was essential and most such applications in England and Wales fail.

The tribunal found Ms Passey's first alleged disclosure, made on 15 June 2026, gave her an arguable case, but did not have the evidence of her second disclosure of 20 June 2026, made to the Financial Services Authority.

It concluded that the respondent had raised sufficient doubt through witness evidence and submissions from advocate Ceri Widdett, meaning Ms Passey had not met the required high standard of proof.

The tribunal directed that a new panel be appointed to hear the case on its merits as soon as reasonably practicable and said the matter could be referred to the Manx Industrial Relations Service after the response is provided.
